I tripped and fell – what do I do?
Trip and falls (also known as slip and fall cases) can happen anywhere. Falls can occur visiting residential homes, restaurants, festivals, at the bank, grocery stores, gas stations, museums, and at the workplace. They are often a result of poorly maintained stairs, sidewalk cracks with debris or where a dangerous condition exists. When someone encounters a walkway that is wet from a spill, or icy from lack of maintenance, that walkway poses a serious threat to anyone who may use them. There is especially great risk of injury for the elderly or a child who encounters these conditions.
A fall completely derails your life when you become injured, and we at Motheral Jones Law are here to help. Falling accidents are a result of poorly maintained premises. It is essential that property owners and managers take great care to ensure spaces are safe, especially where there is an expectation of the public visiting the space.
Some of our clients express concern that they are reluctant to hire an attorney to pursue a case when they slipped and fell at a friend’s home or a place that they frequent. Rest assured that the claims are opened with the insurance company who insured the premises where our clients fell and were injured. That is why we have insurance – for situations such as these.
Claims for slip and fall cases are typically against:
- Commercial property insurance
- Homeowners insurance for a private residence
- Property management companies’ insurance
- Maintenance companies’ insurance
- Government entities insurance
I fell, what should I do?
- Get immediate medical treatment to treat your injuries. The hospital will document the injuries you sustained in the fall and provide a diagnosis. If you had any preexisting injuries that area, please be sure to explain to your treatment providers if your preexisting injury was re-injured or exacerbated by the fall;
- If the premise where the fall happened does an incident report for your fall, please be sure to advocate for yourself that you fell because of the dangerous condition and take note of who did the incident report;
- Document the dangerous condition by taking photos or videos and document your injuries with photos;
- Call Motheral Jones Law as soon as you are able to do so to get an experienced legal team on your side to open up the claims with the proper insurance company that insures the property or area where you fell.
