How long will my case take?

Here at Motheral Jones Law we take pride in explaining the process to our clients every step of the way. This is a foreign experience for them and many of them are hospitalized and seriously injured. It is our job to help our clients understand what is going on in their case so they can focus on getting the treatment they need to get better. 

Our clients often want to know how long the case will take from the date of the collision until a settlement check, verdict or award is distributed to them. The answer, unfortunately, is that it depends. Every single case is different, and the outcome or timeline can not be estimated. 

After a collision, our clients need time to get their treatment. That is the treatment phase of the case. This usually a long duration of time when the client is treating their injuries with their various doctors, specialists, surgeons, and physical therapists. The treatment phase of the case depends on the severity of each client’s injuries and is usually prolonged if they need surgical intervention. 

The goal of medical treatment for any injury is to restore a patient to pre-injury heath. After the treatment phase is completed, and the client has been restored to pre-collision health status, we can then take the steps to move forward into possible settlement negotiations, depending on the case.

If the client is permanently injured from the collision, we wait until there is a plateau in treatment and the client’s doctors have concluded that the client will not be able to be restored to pre-collision health.  

We do not advise attempting to settle a case yourself. You need an experienced attorney who knows the law. Additionally, if your case is settled prematurely, you may cut off your rights to recover the money you deserve. Sometimes additional injuries arise, surgery is needed down the road, or injuries require more treatment than anticipated.
